This document constitutes a legally binding contract under the Indian Contract Act, 1872 and electronic signature provisions of the Information Technology Act, 2000. If you do not agree with any part of these terms, you must refrain from registering or using our platform.

Apna Hamsafar Matrimonial is an exclusive matchmaking portal intended strictly for lawful marriage proposals. To register a profile or use our services, you must satisfy the following statutory conditions:

• Marital Status: Candidates must be legally single, divorced (with a valid court decree of divorce), or widowed. Creating a profile while legally married is strictly prohibited.
• Legal Capacity: The user registering the profile (whether candidate or guardian) must be of sound mind and legally competent to enter into binding legal agreements under Indian law.
• Pure Matrimonial Intent: The platform is designed exclusively for genuine matrimonial introductions. Registration for dating, friendship, commercial exploitation, or casual socializing is strictly forbidden.

3. Bio-Data Authenticity & Member Duty

The foundation of Apna Hamsafar rests on absolute family trust and verified authenticity:

• Truthful Bio-Data: Members warrant that all information provided during registration—including age, educational qualifications, job/profession, income, caste, sub-caste/maslak, family background, and photographs—is 100% true, accurate, and up-to-date.
• Single Profile Per Individual: A candidate or guardian may register only one active profile on the platform. Creating duplicate profiles with varying details is a violation of service rules.
• Mobile OTP Verification: Registration requires mandatory mobile phone verification. Members are responsible for maintaining confidentiality of login credentials and OTP codes.

4. Code of Conduct & Strict Restrictions

To ensure a dignified, safe environment for families, members must strictly adhere to our Code of Conduct:

1. Financial Solicitation / Asking Money: Requesting money, loans, advance gifts, or financial assistance from any potential match under any pretext (e.g., medical emergency, travel expenses) is strictly illegal and ground for immediate police complaint.
2. Misrepresentation & Fake Profiles: Uploading fraudulent identity credentials, impersonating another person, or exaggerating educational/income degrees.
3. Abusive or Vulgar Communication: Sending rude, indecent, harassing, defamatory, or obscene text messages, emails, or images to members or staff.
4. Data Scraping & Commercial Exploitation: Extracting, copying, or scraping profile databases for commercial marketing, telemarketing, or third-party distribution.

5. Membership Plans & Payment Terms

Apna Hamsafar operates on a transparent, non-recurring fee structure:

• Registration Tiers: Initial registration fees (Tier 1: ₹1,000, Tier 2: ₹2,000, Tier 3: ₹3,000) are one-time charges covering profile check, verification, and database listing.
• Service Validity Plans: Subscription packages (6-Month ₹3,100 / 1-Year ₹5,100) cover active match contact coordination services.
• Post-Wedding Success Fees: Success fees are payable upon proposal finalization as per pre-agreed tier levels (50% at engagement, 50% at wedding date fixing).
• Online Fee Payments: Online fee payments are executed securely via SSL-encrypted payment gateways. Transactions are processed in Indian Rupees (INR ₹). All applicable government taxes or GST are displayed during checkout.

6. Role of Intermediary & Mandatory Independent Verification

It is vital for members to understand the legal scope of our services:

Intermediary Status: Under Section 79 of the Information Technology Act, 2000, Apna Hamsafar acts as an intermediary platform facilitating introductions between interested families. While we perform preliminary verification checks and OTP validation, members and their guardians are solely responsible for conducting independent background checks regarding character, health, financial status, legal history, and employment before finalizing any marriage proposal.

Limitation of Liability: Apna Hamsafar shall not be held liable for any direct, indirect, incidental, or consequential losses, personal disputes, or marital incompatibility resulting from interactions initiated through our platform.

7. Intellectual Property Rights

All contents on ApnaHumsafar.com—including website design, logos, graphics, brand icons, source code, software scripts, and proprietary database compilations—are the exclusive intellectual property of Apna Hamsafar Matrimonial and protected under Indian Copyright and Trademark laws. Unauthorized reproduction, modification, or distribution is prohibited.

8. Account Suspension & Termination

Apna Hamsafar reserves the right to suspend or permanently terminate any profile, block IP access, and forfeit paid fees without notice if a member violates these Terms & Conditions, provides fraudulent information, or acts in a manner detrimental to community trust.

9. Governing Law & Dispute Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of India.
